South Africa’s 2020 Asbestos Legislation

The new Asbestos Abatement Regulations published in November 2020, which comes into effect in May of 2022, requires that employers appoint suitably trained personnel who will identify any and all potential asbestos risks in the working environment. Employers are required to maintain an inventory of asbestos containing materials / buildings and equipment and are further required to conduct a risk assessment and suitable management plan. Declaration and notification of these dangerous materials are to be made to the Chief Director: Provincial Operations at the Department of Employment and Labour.

Asbestos Containing Material

Where there is any suspicion as to whether a material contains asbestos, employers will be obliged to contract the services of registered laboratories in order to conduct an analysis of the suspect material to confirm whether or not the material does indeed contain asbestos.

Asbestos Abatement

Where asbestos has been identified, and where asbestos abatement of any sort is to be undertaken, either by qualified employees or external contractors, then employers are required to notify the Chief Director: Provincial Operations at the Department of Employment and Labour of the situation and measures to be taken to mitigate against the risk posed by asbestos. In this case regulation 4 and 5 are applicable.

Asbestos Risk Assessments

Physical areas containing asbestos need to be cordoned off, access should be regulated and suitable signalling and signage will need to be installed until such time as the asbestos has been removed.

As long as there is any asbestos containing material within the workplace, employers will be obliged to employ a competent person to carry out regular risk assessments (every 24 months minimum). The new legislation also requires that the situation pertaining to on-site asbestos including a risk assessment be reviewed by an approved inspection authority at regular intervals not exceeding 6 years.

How South Africa’s New Asbestos Legislation Affects Asbestos Work And Asbestos Removal

Type 1 Asbestos work

The new Asbestos regulations also pertains to any work effected on Asbestos containing materials. Where less than 10 m2 is involved, then as long as removal is done within the regulations, contractors are not required to register with the chief inspector.

Type 2 Asbestos work

Specific regulations affect the repair of asbestos based cementitious products including insulating board that require surface preparation. In this case only contractors registered at level 2 with the Chief Inspector are allowed to conduct this type of work.

Type 3 Asbestos work

Specific regulations affect the repair, removal or encapsulation of any material containing asbestos. Only contractors who sport a type 3 certification from the Chief Inspector are allowed to conduct this work. Regulations at this level are in line with international standards.
